GENERAL TERMS AND CONDITIONS OF PURCHASE – SORELLAS THE BRAND BARCELONA, S.L.

These general terms and conditions of purchase set forth the terms governing the purchase of products through the website https://sorellasthebrand.com using any application or device used to access the website. These terms and conditions are supplemented—in matters not covered herein—by the website’s privacy policy, cookie policy, and terms of use set forth in the legal notice, and are available for your reference, if you wish, in the website’s footer.

 1. USE OF THE WEBSITE

Use of this website is limited to making inquiries or placing orders, which must be truthful; if there is any suspicion that this is not the case, we reserve the right to notify the appropriate authorities as deemed necessary. The personal data requested to process inquiries and orders must be accurate and truthful and will be processed by SORELLAS in accordance with its privacy policy.

The language used to execute the contract shall be Spanish.

2. GEOGRAPHICAL SCOPE OF THE SALE

Items for sale on this website can only be shipped to mainland Spain, Mallorca, Portugal, France, and the rest of Europe, with the exception of certain countries and regions. If we do not ship to any of the destinations you specify, we will let you know as soon as you indicate the shipping destination for your order before completing the purchase.

3.ORDER FULFILLMENT PROCESS

To place an order, follow the website’s checkout process, click on the items you wish to purchase, enter the requested information, select a delivery method and payment method, and finally click “Pay.”

Normally, the confirmation windows during the checkout process do not allow you to proceed if the information has not been entered correctly. However, if, after filling out the information requested on the checkout forms, you notice an error in the information you entered, you can request a correction by sending an email to info.sorellasthebrand@gmail.com as soon as possible, or you can modify it yourself in your customer account.

All orders for items are subject to availability; therefore, if we do not have the purchased product in stock and this was not previously indicated during the checkout process or on the product page itself, we will notify you and refund any amount paid for the item as soon as possible.


4. DELIVERY OF THE ITEMS.

During the checkout process, you will need to select the delivery method that best suits your needs, choosing between standard and expedited shipping.

In some cases, for reasons beyond our control, we may be unable to meet the delivery deadlines listed above; in such cases, we will deliver the item to you within a maximum of 30 calendar days from the date your order is confirmed. If we are unable to meet the above maximum timeframe, we will notify you of this circumstance and give you the option to proceed with the purchase by setting a new delivery date or to cancel the order and receive a refund of the amount paid.

In any case, an order shall be deemed delivered at the time it is made available to you or to a third party designated by you—that is, at the time you take physical possession of the order.

If you are not at home, a second delivery attempt will be made, arranged with the shipping company via email, or a pickup at a nearby location will be arranged via the shipping company's email.

When your order leaves our warehouse, you’ll receive an email. Later, you’ll receive another email from the shipping company with the delivery date. They’ll also give you the option to change the delivery date and location for free, as long as it’s nearby. You can choose one of the pickup locations. The next day, you’ll receive an email letting you know the time you’ll receive your order. If more than 7 days pass and the package is returned to our facility, and the customer does not pick it up, the customer will be responsible for the return shipping costs as well as the costs to reship the order. If two delivery attempts are made and the customer is absent, the customer will be responsible for the return shipping costs; if the customer wishes to receive the order again, they will also be responsible for the new shipping costs.
Ifthe orderis returned to the sender (i.e., Sorellas),we will hold it for 1 month; however, if the customer does not claim it within that time, they will have no right to claim either the amount paid or the contents of the order, which will be donated to the Red Cross.

 If you have chosen the “pickup” delivery option, your order will be delivered to the location specified during the checkout process within a maximum of 48 hours from the time of purchase. When your order is ready for pickup, you will receive an email notifying you. To pick up your order, you must present your ID and order number, or authorize a third party to do so; in this case, you must notify SORELLAS in advance of the pickup, and the authorized person must present their ID. Orders are held for 1 month; if you have not picked up your order after one month, you will not be entitled to claim either the amount paid or the contents of the order, and it will be donated to the Red Cross.

From the moment the order is delivered, you will assume all risk for the items included in the order.

5. PRICEOF ITEMS AND PAYMENT.

 The prices listed on the website include Value-Added Tax (VAT) but do not include shipping costs, which will be indicated when the user specifies the shipping destination for the order and which, barring changes in shipping rates, will be equal to the amounts specified in Section 4 of these General Terms and Conditions.

Once you have added all the items you wish to purchase to yourCARTand provided the information requested to complete the purchase, the final step will be to pay for the items by filling out the required payment information. Before proceeding to checkout, you may modify your order details if you wish.

All transactions are conducted in euros, unless another currency is specified. If payment is made in another currency, the conversion is based on the exchange rate on the day of purchase.

SORELLAS offers two payment methods: 

  • By Visa, Maestro, American Express, and/or MasterCard. For the payment process, each bank uses its own security system; some require an additional password, others send you a secret code via text message, and others require authentication through an app. If you’d like to know the specific process, please contact your bank. By clicking “Pay,” you are confirming that the card used is yours or that you are its legitimate holder. SORELLAS will not have access to your credit card information. 
  • Via PayPal (https://www.paypal.com/es/home). PayPal allows any consumer with an email address to send and receive payments securely. By clicking the “Pay with PayPal” link, you’ll be taken to PayPal’s secure website, where, if you already have a PayPal account, you can authorize the payment. If you don’t have a PayPal account yet, you can sign up for free and pay for your orders.

To purchase our products, you can either register on the website or proceed without registering; in the latter case, you will only be asked to provide the information necessary to complete the purchase and process your order.

 6. RIGHT OF WITHDRAWAL AND DAMAGED ITEMS.

  • Right of Withdrawal.

If you make a purchase as a consumer and user (which is usually the case), you have the right to withdraw from this sales contract within 14 calendar days without having to provide any justification. The period for exercising the right of withdrawal will end 14 calendar days from the day on which you or a third party designated by you took physical possession of the items or, in the case of delivery of multiple goods ordered by the consumer and user in the same order and delivered separately, the day on which the consumer and user or a third party designated by them, other than the carrier, takes physical possession of the last of the goods; or, in the case of delivery of a good consisting of multiple components or parts, the day on which the consumer and user or a third party designated by them, other than the carrier, takes physical possession of the last component or part.

To exercise your right of withdrawal, you must notify us unequivocally by email atinfo.sorellasthebrand@gmail.com. You may use the sample form provided below, although its use is not mandatory:

– I/We (*) hereby notify you that I/we (*) am/are withdrawing from my/our (*) contract for the sale of the following property (*)

To meet the withdrawal deadline, it is sufficient to send the notice regarding your exercise of this right before the applicable deadline expires.

If you cancel your order, we will refund all payments received from you, including shipping costs (with the exception of any additional costs resulting from your choice of a shipping method other than the least expensive standard shipping method we offer), without undue delay and, in any case, no later than 14 calendar days after receiving the order. We will process this refund using the same payment method you used for the initial transaction. In any case, you will not incur any costs as a result of the refund, except for those expressly indicated below.

We may withhold the refund until we have received the goods, or until you have provided proof that you have returned them, whichever occurs first.

 You must return the goods to us or deliver them directly to Carrer Riu Sec 45, Nave 37 - 08290 Cerdanyola del Valles, after scheduling an appointment and at the agreed-upon time, or through an intermediary that will handle the return (such as the postal service or similar), without any undue delay and, in any case, no later than 14 calendar days from the date you or a third party of your choice received the product. The deadline will be considered met if you return the goods before the end of that period.

You will be responsible for the direct cost of returning the goods.

You will be solely responsible for any decrease in the value of the goods resulting from handling beyond what is necessary to verify the nature and characteristics of the items. 

In any case, you will not have the right of withdrawal for contracts involving personalized items or items sealed for health or hygiene reasons that have been unsealed after delivery. You may only exercise your right of withdrawal for items that are returned in the same condition in which you received them. No refund will be issued if it is determined that the item has been used beyond simply opening the package, if the item is not in its original condition, or if it has been damaged; therefore, we recommend that you take the utmost care while the items are in your possession. Returns must include the original packaging and accompanying labels. 

After inspecting the item, you will be notified whether or not the price paid will be refunded. If it is ultimately determined that you are not entitled to cancel the contract, the item will be made available to you again; if, two months after it has been made available, you refuse to accept it (at your own expense) or fail to pick it up, the item will be considered abandoned.


  • Defective Items

We apologize if you received a product with a manufacturing defect. Our team carefully inspects every item before it is shipped, so this is not common, but if it does happen, we will be happy to replace the item with one that is in perfect condition. You must notify us via email , and we recommend that you do so within 2 calendar days of receiving the item—that is, no later than the day after you receive it.

  • Please send an email to info.sorellasthebrand@gmail.com with photos showing the defect in the item, the name of the person who placed the order, and the order number.
  • Our team will inspect the merchandise and, provided the conditions have been met, will issue a replacement for the item within 15 business days (Sorellas will cover the shipping costs for the replacement). If you do not wish to receive a replacement, the order will be processed as a return and you will be refunded for the item.

Sorellas The brand will assess the damage upon arrival at the facility.

* IMPORTANT NOTE: Returns for defective items will only be accepted if the product still has its original tags attached. Otherwise, it will be assumed that the item has been used and that the defect was caused by improper use.

** Customers who initiate a return for a defective product assume full responsibility, as well as all legal consequences that may arise from bad-faith conduct constituting fraud. Once the defective product arrives at our facilities, our team will assess whether it is a manufacturing defect. If it is not, the customer will be responsible for the shipping costs to our facilities. To report a defective item, you must always send an email to: info.sorellasthebrand@gmail.com

When Sorellas receives a returned item that has been damaged by the customer or sent without the original tags, it will contact the customer so that they can retrieve their item by paying the shipping costs again. If the customer does not pay these shipping costs within one month, they will lose the right to retrieve the item, and it will be donated to the Red Cross.

 7. INVALIDITY AND AMENDMENT OF THE TERMS AND CONDITIONS.

If any of these general terms and conditions is declared null and void by a final judicial decision issued by a competent authority, the remaining provisions shall remain in effect and shall not be affected by such declaration of nullity.

We also reserve the right to modify these general terms and conditions, provided that such modifications are not retroactive.

8. CONFORMITY GUARANTEE

As a consumer, when purchasing goods, you should know that our products at
are covered by a warranty for any lack of conformity that exists at the time
of delivery and that becomes apparent within three years of delivery

9. APPLICABLE LAW, JURISDICTION, AND DISPUTE RESOLUTION. 

The contracts for the purchase of items offered on this website shall be governed by Spanish law. Any dispute arising from the use of this website or the interpretation of these terms and conditions shall be subject to the jurisdiction of the courts of Barcelona (Spain).
