LEGAL TERMS CLINIQUE X SORELLAS SWEEPSTAKES
The Company Sorellas The Brand with address at Carrer Riu Sec 45, Nave 37, 08290 Cerdanyola del Vallès, Barcelona, together with Clinique, organize a national sweepstakes, to be carried out through social networks, exclusively for users residing in the Spanish peninsula in accordance with the provisions of the participation requirements section.
2.- Dates
The DRAW begins on January 31, 2025 at 12:30 am and ends on March 6, 2023 at 11:59 pm.
The celebration of the DRAWING may change in terms of dates, and may not even be held at the discretion of CLINIQUE ESPAÑA.
Date changes, and the possible non-celebration of any of them will be indicated in the account of CLINIQUE ESPAÑA in its Instagram profile (@clinique_es).
3.- Participation and Acceptance of bases.
The development and participation in the Sweepstakes is carried out through the social network INSTAGRAM (www.instagram.com).
Participants in the Sweepstakes accept these Terms and Conditions in all its terms and conditions, and must not participate in the Sweepstakes if they do not accept these Terms and Conditions. CLINIQUE ESPAÑA reserves the right to change these rules.
Participants.
All natural persons of legal age, residing in Spain, who are not employees or workers of CLINIQUE ESPAÑA or of the suppliers or companies collaborating in the BEAUTY TESTER, or their relatives in the first degree of kinship, may participate in the DRAW.
Participants in the DRAW must have an account as a user of the social network INSTAGRAM to participate. And be a follower of the account or profile CLINIQUE ESPAÑA, PPRIMOR & PARQUE WARNER in the social network.
Mechanics of participation.
The communication of the DRAW will be by means of a post in the feed and a storie. Once the DRAW has started and being a follower of the INSTAGRAM accounts, participants must follow the steps indicated to get the prize-winning product:

6.-Winners.
There will be 1 winner and will win 1 Sorellas dress and 1 set of Clinique products.
CLINIQUE ESPAÑA reserves the right to modify these prizes, and the conditions of the winners, as well as the dates of the DRAW, or the non-holding of the same.
7.- Communication of winners and awarding of prizes.
CLINIQUE SPAIN will contact the winners via Instagram.
CLINIQUE ESPAÑA may request the necessary information/documentation from the prize winners to verify that they meet the conditions to be participants and be entitled to the prize. Winners may forfeit their right to the prize if they do not submit the information/documentation requested by CLINIQUE ESPAÑA.
The Clinique product will be sent by postal mail to the address provided by the winners. We only ship to mainland Spain and the Balearic Islands (excluding the Canary Islands, Ceuta and Melilla).
In the event that CLINIQUE ESPAÑA is unable to deliver the prize due to an incorrect, incomplete or missing postal address, CLINIQUE ESPAÑA reserves the right to withdraw the prize.

8.- Awards
Prizes are not redeemable or exchangeable for cash or any other product or service.
Responsibilities and operation.
CLINIQUE ESPAÑA is not responsible for the impossibility of connection or communication of the participants with the social network INSTAGRAM to participate, nor for the impossibility of participating in this SWEEPSTAKES.
All expenses derived from the connection or communication of data through the Internet or other communication network, in order to participate in the DRAW will be at the expense of the participants.
10.- Processing of personal data.
Participants' personal data are collected by the Organizing Company to administer the Sweepstakes according to the terms and conditions defined in these Sweepstakes rules and in the Privacy Policy.
The Organizing Company may share the personal data of the Participants with the collaborating companies of said DRAW, its affiliates, external suppliers, agencies, or contractors hired by the Organizing Company to assist in the operation and proper execution of the DRAW. These third parties may only use the personal data for tasks specific to the Sweepstakes and may not use it for any other purpose.
Participants may exercise their RIGHTS OF ACCESS, RECTIFICATION, DELETION, OPPOSITION, LIMITATION OF PROCESSING AND PORTABILITY, free of charge, by writing to the following address:

Participants may contact the Spanish Data Protection Agency (AEPD) and other competent public bodies for any claim arising from the processing of their personal data.
11.- Disqualifications
In the event that the terms and conditions of the DRAW participants agree that CLINIQUE ESPAÑA or any entity that is professionally related to the present promotion detects any anomaly or suspects that a participant is impeding the normal development of the promotion, providing false, erroneous or incomplete data, he/she may be disqualified and deprived, if applicable, of his/her status as winner.
CLINIQUE ESPAÑA reserves the right to eliminate from the SWEEPSTAKES any participant who evidences or is suspected of irregular behavior.
12.- Instagram social network
INSTAGRAM does not sponsor, endorse or administer this promotion in any way, nor is it associated with it. And there is a total disassociation of each participant with respect to INSTAGRAM, with participants providing the information to CLINIQUE ESPAÑA and not to INSTAGRAM.
13.- Legislation
These legal bases shall be governed in accordance with Spanish law. The Courts and Tribunals of the city of residence of the Participants will be competent to resolve any claim or controversy that may arise in relation to the validity, interpretation or fulfillment of these rules.
14.- Language
The rules of the Sweepstakes and other texts, legends and conditions are written in Spanish. The translation into another language is made for convenience, being only valid the Spanish version, in case of possible interpretations and meaning of these rules.
15.- Jurisdiction.
Any controversy that may arise regarding the interpretation and application of these rules and the development or participation in the Sweepstakes, both CLINIQUE ESPAÑA and the participants expressly submit to the jurisdiction of the Courts and Tribunals of Madrid.

treatment of the User's personal data and informs you that these data will be treated in accordance with the provisions of current regulations on personal data protection, Regulation (EU) 2016/679 of 27 April 2016 (GDPR) on the protection of natural persons with regard to the processing of personal data and the free movement of such data.

1. USE OF THE WEB SITE
The use of this website must respond to the realization of queries or orders, if any, truthful, being entitled, if suspected otherwise, to inform the competent authorities deemed appropriate. The personal data requested for the attention of queries and orders must be accurate and truthful being treated by SORELLAS in accordance with its privacy policy.
The language used to formalize the contract shall be Spanish.
2. TERRITORIAL SCOPE OF THE SALE
The items offered for sale on this website can only be shipped to mainland Spain, Mallorca, Portugal, France and the rest of Europe, except some countries and areas. If we do not ship to any of the destinations indicated by you, we will let you know when you indicate the destination of your order before formalizing the purchase.
3. ORDERING PROCESS
To initiate an order you must follow the purchase process of the website, click on the items you wish to purchase, indicate the requested information, choose delivery method, payment method and finally click on "pay".
Normally the confirmation windows of the purchase process do not allow to continue if the data have not been provided correctly, nevertheless, if after the completion of the data requested in the purchase forms you detect any error in the data entered, you can request its rectification by sending an email to info.sorellasthebrand@gmail.com as soon as possible or modify them yourself in your customer area.
All orders of items are subject to availability so, if we do not have stock of the product purchased and this had not been previously indicated during the purchase process or on the page of the item itself, we will proceed to let you know and refund the money that had been paid for it as soon as possible.
4. DELIVERY OF THE ARTICLES.
During the purchase process, you must indicate the delivery method that best suits your needs, choosing between ordinary and express.
In some cases it is possible that, for some reason beyond our control, we could not meet the above delivery deadlines, and we must, at most, deliver the item within a maximum period of 30 calendar days from the date of order confirmation. In the event that we are unable to meet the above deadline, we will inform you of this circumstance and give you the option to continue with the processing of the purchase, setting a new delivery date or cancel the order with a refund of the price paid.
In any case, an order shall be deemed to have been delivered at the time it is made available to you or to a third party indicated by you, i.e. at the time you acquire material possession of the order.
In case you are not at home, a next delivery attempt will be made, arranged with the transport company via email or a delivery will be arranged at a nearby pick up point via email from the transport company.
When the order leaves our warehouse, you will receive an email. Afterwards, you will receive an email from the shipping company informing you about the delivery date. They will also give you the option to change the date and place of delivery free of charge, as long as it is close to you. You can choose one of the pick-up points. The next day, you will receive an email informing you of the time you will receive your order. In the event that more than 7 days pass, the shipment will be returned to our facilities, and the customer does not go to pick it up, he/she will have to assume the costs of the return of the package, as well as the shipping costs again. In the event that two delivery attempts are made and the customer is absent, it will be the customer who assumes the costs of return shipping and in the case of wanting the order again, the shipping costs of this.
In the case of being returned to origin, ie Sorellas, we will keep the order for 1 month, but in case of claiming it, the customer is not entitled to claim either the amount or the contents of the order, will be donated to the Red Cross.
In the event that you have opted for the "pick up" delivery option, your order will be delivered to the place indicated in the purchase process within 48 hours of purchase. When the order is available for pick up you will be sent an email to let you know. For the collection you must present your ID and order number or authorize a third party, for which must be indicated to SORELLAS prior to collection, and the authorized person must present your ID.
From the time of delivery of the order, you bear the risk of the items that make up the order.
5. PRICE OF THE ARTICLES AND PAYMENT.
The prices indicated on the website include Value Added Tax (VAT) but not shipping costs, which will be indicated at the time the user specifies the place of shipment of the order and which will be equivalent, unless there are changes in the price of transport, to the amounts specified in paragraph 4 of these general conditions.
Once you have included all the articles that you wish to buy in your "CART" and indicate the requested data to formalize the purchase, the last step will be the payment of the price of the same ones filling up the data that for it are requested to him. Before proceeding to the payment, if you consider it convenient, you will be able to modify the data of your order.
All transactions are in Euros, unless another currency is specified. If payment is made in another currency, the conversion is based on the exchange rate of the day on which the purchase is made.
SORELLAS offers two methods of payment:

- Via PayPal (https://www.paypal.com/es/home). PayPal allows any consumer with an email address to securely send and receive payments. By clicking on the "Pay with PayPal" link, you can access PayPal's secure website, where, if you already have a PayPal account, you can authorize payment. If you do not yet have a PayPal account, you can register for free and make payments for your orders.

6. RIGHT OF WITHDRAWAL AND DAMAGED GOODS.
- Right of withdrawal.
If a purchase is made in the condition of consumer and user (which is normally the case), you have the right to withdraw from this purchase contract within 14 calendar days without the need for any justification. The period for exercising the right of withdrawal shall end 14 calendar days from the day on which you or the third party indicated by you acquired material possession of the goods or, in case of delivery of multiple goods ordered by the consumer and user in the same order and delivered separately, the day on which he or a third party indicated by him, other than the carrier, acquires the material possession of the last of the goods or, in case of delivery of a good composed of multiple components or parts, the day on which the consumer and user or a third party indicated by him, other than the carrier, acquires the material possession of the last component or part.
To exercise the right of withdrawal you must communicate it unequivocally by email to the address info.sorellasthebrand@gmail.com. for which you can use the model form below although its use is not mandatory:

In order to meet the withdrawal deadline, it is sufficient that the communication concerning your exercise of this right is sent before the expiration of the withdrawal period.
In case of withdrawal on your part, we will refund all payments received from you, including delivery charges (with the exception of the additional costs resulting from your choice of a delivery method other than the least expensive ordinary delivery method offered by us) without undue delay and, in any case, no later than 14 calendar days after receipt of the order. We will proceed to effect such reimbursement using the same means of payment used by you for the initial transaction. In any case, you will not incur any costs as a result of the refund except those expressly indicated below.
We may withhold reimbursement until we have received the goods, or until you have provided proof of return of the goods, whichever condition is met first.

You must bear the direct cost of returning the goods.
You shall only be liable for any diminished value of the goods resulting from handling other than what is necessary to verify the nature and characteristics of the goods.
In any case, you will not have the right of withdrawal in contracts where the object is a personalized item or sealed items for health or hygiene reasons that have been unsealed after delivery. You may only exercise your right of withdrawal on those items that are returned in the same condition in which you received them. No refund will be made if it is detected that it has been used beyond the mere opening of the same, items that are not in the same condition in general or have suffered any damage, so it is recommended to take the utmost precautions while the items are in your possession. The return must be made including the original packaging and accompanying labels.
After an examination of the item you will be informed whether or not to proceed to the refund of the price paid. If, finally, it is decided that you do not have the right to withdraw from the contract, the item will be made available to you again and if after two months from the time it is made available you refuse to receive it (at your expense) or you do not pick it up, the item will be considered abandoned.
- Defective items
We are sorry if you have received a product with a manufacturer's defect. Our team carefully checks each item before it is shipped, so it is not usual, but if this happens, we will be happy to replace the item with the same item that is in perfect condition. You must notify us via email and we recommend that you do so within 2 calendar days of receiving it, i.e., at the latest, the day after you receive it.
- Please send an email to info.sorellasthebrand@gmail.com with the photos proving the defect of the item, the name of the person who made it and the order number.
- Our team will review the merchandise and will issue, if the conditions have been met, a replacement item within a period not exceeding 15 working days (Sorellas will assume the shipping costs of the replacement). In the case of not wanting the replacement, it will be handled as a return and the item will be refunded.
Sorellas The brand will assess the damage upon arrival at the facility.
* IMPORTANT NOTE: Returns for defective item will only be accepted when the product retains its labeling. Otherwise, it will be understood that the item has been used and the defect is due to improper use.
** The customer who manages a return for defective product assumes its responsibility, as well as all legal consequences that may arise from a bad faith conduct constituting fraud. Once the defective product arrives at our facilities, the team will assess whether it is a manufacturing defect. If it is not, it will be the customer who assumes the shipping costs to our facilities. To inform us that an item is defective, you must always write an email to: info.sorellasthebrand@gmail.com
When Sorellas receives a returned item with any damage made by the customer or that has been sent without the original labeling, Sorellas will contact the customer to recover the item by paying the shipping costs again. If in a period of 1 month the customer does not pay for this shipment, he/she will have lost the possibility of recovering it and it will be donated to the Red Cross.
7. NULLITY AND MODIFICATION OF THE CONDITIONS.
In the event that any of these general terms and conditions are declared null and void by a final judicial decision issued by a competent authority, the remaining clauses shall remain in force, without being affected by such declaration of nullity.
We also reserve the right to modify these general terms and conditions without retroactive effect.
8. GUARANTEE OF CONFORMITY
As a consumer, in the case of sale of goods, you should know that our
products have a warranty for any lack of conformity that exists at the time
of delivery of the product and that manifests itself within three years from the delivery
of the product.
9. GOVERNING LAW, JURISDICTION AND DISPUTE RESOLUTION.
Contracts for the purchase of articles offered on this website shall be governed by Spanish law. Any dispute arising from the use of this website or the interpretation of these clauses shall be submitted to the jurisdiction of the Courts and Tribunals of Barcelona (Spain).
